Last Updated: June 9, 2026
Welcome to Rincon Weed and Pest Control! By accessing or using our services, including but not limited to visiting our website at rinconweedandpest.com, scheduling appointments, or receiving treatments at your property, you agree to be bound by the following Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you ("Customer," "You," "Your") and Rincon Weed and Pest Control ("Company," "We," "Us," "Our"), a State of Arizona, Department of Agriculture licensed and insured weed and pest control service provider. If you do not agree to these Terms, you may not use or schedule our services.
2. Services Provided
Rincon Weed and Pest Control provides professional management solutions for residential and commercial properties within Rincon Valley, Arizona, and surrounding service areas.
2.1. Weed Control Services
Pre-Emergent Herbicide: Applied to soil to inhibit weed seed germination. This is a preventative measure designed to reduce future weed growth.
Post-Emergent Herbicide: Direct application to existing, actively growing weeds to eradicate them.
Specialty Weed Management: Targeted treatments for stubborn, invasive, or deeply rooted species (e.g., Buffelgrass, Bermuda grass) which may require custom protocols.
2.2. Pest Control Services
General Pest Control: Interior and exterior barrier treatments targeting common crawling insects, spiders, scorpions, and stinging insects.
Rodent Control: Implementation of trapping, baiting, and exclusion monitoring systems.
Specialized Treatments: Advanced services targeting termites, bed bugs, or wildlife, which are subject to separate, specific service addendums.
Subscription Programs: Ongoing maintenance agreements involving recurring treatments tailored to seasonal pest and weed cycles.
3. Quotes, Pricing, and Payment
3.1. Custom Quotes
All quotes are property-specific and calculated based on square footage, environmental density, structural layouts, and the severity of the weed or pest pressure.
3.2. Property Condition Disclaimer
Quoted prices assume the property is reasonably well-maintained, clear of excessive debris, and safely accessible.
Right to Re-Quote: If upon arrival our technicians discover severe overgrowth, hazardous debris, hoarding conditions, or structural impediments, we reserve the right to revise the quote, apply additional labor fees, or cancel the service at our sole discretion.
3.3. Payment Terms
Due Date: Payment is due immediately upon completion of service unless a recurring billing cycle or subscription plan has been authorized in writing.
Late Fees: Past-due balances exceeding thirty (30) days are subject to a late fee of 1.5% per month (or the maximum allowable by law) plus any accrued collection costs.
Payment Methods: We accept valid credit cards, electronic fund transfers (EFT), and other payment methods designated on our invoices.
4. Scheduling, Access, and Safety
4.1. Appointment Windows
While we strive for precise scheduling, the nature of our business relies on variables like weather and traffic. We provide estimated arrival windows. We will make reasonable efforts to notify you of any unexpected delays.
4.2. Property Access Requirements
To ensure an effective and safe application, the Customer must provide:
Unlocked gates and unobstructed access to all treatment areas.
Clearance of personal property, toys, outdoor furniture, and vehicles from the immediate treatment zones.
Temporary shut-off of automated irrigation systems during and immediately following weed treatments.
4.3. Pet and Child Safety Protocol
⚠️ CRITICAL SAFETY NOTE: For the protection of non-target residents, all children, pets, and domestic animals must remain indoors during the application of any chemical treatments. They must remain indoors until the treated areas are completely dry, or for the specific duration explicitly communicated by our technicians.
5. Customer Responsibilities
To optimize service efficacy, the Customer agrees to:
Disclose all known environmental sensitivities, chemical allergies, or organic gardens on the property prior to application.
Strictly follow post-treatment instructions, including specific watering cycles, exclusion recommendations, and structural sanitation tips.
Promptly report any unsatisfactory results or suspected issues within forty-eight (48) hours of service.
6. Service Guarantees, Limitations, and Liabilities
6.1. Efficacy Expectations
While our treatments leverage professional-grade materials, external variables beyond our control—such as localized weather anomalies, soil composition, neighboring properties, and extreme biological pressures—can influence outcomes. We do not guarantee 100% eradication of all pests or weeds indefinitely.
6.2. Subscription Retreatment Policy
For active subscription customers, we provide localized re-treatments between regularly scheduled visits if target pest or weed populations break through our barriers, subject to the parameters of your specific plan. One-time service calls do not include complimentary follow-up treatments unless explicitly stated in writing.
6.3. Property Damage and Liability Exemptions
Rincon Weed and Pest Control exercises maximum professional care. However, the Company is not liable for:
Staining, discoloration, or chemical interactions with older, weathered, unsealed, or non-standard construction materials, concrete, pavers, or outdoor fabrics.
Inadvertent damage to non-target ornamental plants, turf, or trees due to unpredictable subterranean root systems or unavoidable drift during selective weed control.
Pre-existing structural damage caused by wood-destroying organisms, rodents, or wildlife prior to or during the implementation of our management programs.
7. Cancellation and Rescheduling
Customer Notification: You may cancel or reschedule a service window by providing at least 24 hours’ notice. Cancellations made with less than 24 hours' notice may incur a standard trip/administrative fee.
Company Adjustments: We reserve the right to unilaterally reschedule applications due to unsafe weather conditions (e.g., high winds, heavy rain, extreme heat) that compromise chemical safety or efficacy guidelines set by the EPA or State regulations.
8. Disclaimers and Limitations of Liability
8.1. Warranty Disclaimer
ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EXCEPT AS EXPLICITLY STATED HEREIN, THE COMPANY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY.
8.2. Damage Cap
IN NO EVENT SHALL RINCON WEED AND PEST CONTROL, ITS OWNERS, TECHNICIANS, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF THIS AGREEMENT OR THE SERVICES PROVIDED SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO THE COMPANY FOR THE SPECIFIC SERVICE VISIT GIVING RISE TO THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless Rincon Weed and Pest Control, its officers, employees, and field agents from and against any third-party claims, liabilities, losses, damages, or legal expenses (including reasonable attorneys' fees) arising out of your negligence, failure to secure pets or children, withholding of critical property information, or violation of these Terms.
10. Governing Law and Jurisdiction
These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any formal legal proceeding or dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Pima County, Arizona.
11. Amendments to Terms
We reserve the right to update or modify these Terms at any time without prior individual notice. The most current version will always be posted on our website. Your continued scheduling of appointments or receipt of services following an update constitutes definitive acceptance of the revised Terms.
